An owner or purchaser under land sale contract of property may apply to disconnect the property from the public drainage system by submitting proof satisfactory to the City Engineer that:

A. All impervious surface area of the property has been demolished and removed; or,

B. There exists on the property a storm and surface water retention and infiltration system designed and operated so as to dispose of all such water in any foreseeable storm event without use of the public drainage system. By its application the owner or purchaser shall be deemed to have given consent to the city’s entry onto the property to verify the matters stated in the application. Disconnection shall not be effective to allow the user of the property to avoid the charge unless and until the City Engineer confirms in writing that the disconnection meets the criteria of this section.
