In no instance shall the city or any officer or employee of the city be liable for payment of any reimbursement fee or portion thereof as a result of the city’s determination of the person responsible to pay the reimbursement fee under BC 3.03.100. Only those payments the city receives from or on behalf of properties in a reimbursement district shall be remitted to the developer. The city’s general fund or other revenue sources shall not be liable for or subject to payment of outstanding and unpaid reimbursement fees imposed upon private property.
